Terms of Service and Risk Disclosure Agreement

IMPORTANT NOTICE: PLEASE READ CAREFULLY

THIS DOCUMENT CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN YOU ("THE USER") AND ASSETARY PRIVATE LIMITED ("THE COMPANY"). BY PURCHASING, DOWNLOADING, ACCESSING, OR USING THE "RELTIN INTELLIGENCE REPORT," YOU EXPLICITLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OR USE THE REPORT.

1. Definitions and Interpretation

  • 1.1. "Company" refers to Assetary Private Limited, its subsidiaries, directors, employees, contractors, and affiliates.
  • 1.2. "Report" refers to the "Reltin Intelligence Risk Report," including all scores, data points, flags, and analytics contained therein.
  • 1.3. "User" refers to the individual or entity purchasing or accessing the Report.
  • 1.4. "Public Records" refers to data sourced solely from third-party government and judicial databases, including but not limited to RERA, NCLT, District Courts, High Courts, and Municipal Corporations.
  • 1.5. "Beta Phase" refers to the current testing stage of the platform where features and data accuracy are under development.

2. Nature of Services: Aggregation Only

2.1. Platform Nature:

The Company operates strictly as a data aggregator and analytics provider. The Company is not a real estate brokerage, law firm, financial consultancy, or investment advisory.

2.2. Source of Information:

You acknowledge that 100% of the data in the Report is sourced programmatically or manually from Public Records. The Company does not create, manufacture, or generate any primary data regarding the property or developer.

2.3. No Verification of Original Records:

The Company aggregates data "as is" from Public Records. If the original government record (e.g., a RERA filing) contains errors, omissions, or false information submitted by a developer, the Report will reflect those errors. The Company accepts no liability for the inaccuracy of official government records.

3. Strict "No Advice" Disclaimer

3.1. No Financial or Legal Advice:

The content of the Report is for informational purposes only. It does not constitute:

  • Legal advice or legal opinion.
  • Financial investment advice.
  • A recommendation to buy, sell, or hold any asset.
  • A guarantee of the property's future value or legality.

3.2. No Endorsement or Condemnation:

  • Trust Scores are not verdicts: A high Trust Score does not guarantee a risk-free investment. A low Trust Score does not guarantee fraud. These are algorithmic indicators based on available data.
  • No "Good" or "Bad" Labels: We do not label properties as "Good" or "Bad." We present factual "Red Flags" (Risk) and "Green Flags" (Compliance) based on logic. The interpretation of these flags is solely the User's responsibility.

3.3. User Responsibility:

The decision to enter into any real estate transaction is solely yours. You agree that you will not rely solely on this Report and will conduct your own independent due diligence, including physical site visits.

4. Beta Testing and Data Accuracy

4.1. Beta Acknowledgment:

You explicitly acknowledge that the Service is in a "Beta" state. This means:

  • The software may contain bugs, errors, or data parsing failures.
  • The OCR (Optical Character Recognition) technology used to read court documents may occasionally misinterpret text.
  • The database may not be exhaustive (e.g., it may miss a court case filed in a jurisdiction not yet covered by our crawlers).

4.2. "Snapshot" Validity:

The Report represents the status of the property only at the precise moment of generation. Real estate is dynamic. A developer may be taken to insolvency court (NCLT) one hour after you download this Report. The Company is not responsible for any events occurring after the Report is generated.

5. Limitation of Liability (Critical Clause)

5.1. Total Immunity:

To the maximum extent permitted by Indian Law, Assetary Pvt Ltd and its officers shall NOT be liable for:

  • Any direct, indirect, incidental, special, consequential, or exemplary damages.
  • Financial loss, loss of profits, loss of goodwill, or data loss.
  • Any loss resulting from a stalled project, litigation, or fraud committed by a developer, even if the Report failed to predict it.

5.2. Monetary Cap:

In the event that a court of competent jurisdiction holds the Company liable for any reason, the aggregate liability of the Company shall be strictly limited to the amount paid by the User to purchase the specific Report (e.g., ₹99, ₹199, or ₹1,499).

5.3. No Third-Party Liability:

The Company is not responsible for the actions or omissions of third parties, including developers, government agencies (RERA), or banks.

6. Intellectual Property Rights

6.1. Ownership:

All proprietary algorithms, the "Trust Score" logic, report formatting, design, and analysis contained in the Report are the exclusive intellectual property of Assetary Pvt Ltd.

6.2. License to Use:

You are granted a limited, non-exclusive, non-transferable license to use the Report for personal, non-commercial use only.

6.3. Prohibitions:

You shall not:

  • Resell, redistribute, or publish the Report on social media or public forums.
  • Reverse engineer the "Trust Score" algorithm.
  • Use the Report to build a competing database or service.

7. Indemnification

You agree to indemnify, defend, and hold harmless Assetary Pvt Ltd, its directors, and employees from any and all claims, demands, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Report.
  • Your violation of these Terms.
  • Any investment decision you make based on the Report.

8. Force Majeure

The Company shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Company's reasonable control, including but not limited to mechanical, electronic, or communications failure (e.g., Government server downtime, RERA website crashes).

9. Governing Law and Dispute Resolution

9.1. Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of India.

9.2. Dispute Resolution:

  • Any dispute arising out of this Agreement shall first be attempted to be resolved amicably through email correspondence.
  • If unresolved after 30 days, the dispute shall be referred to arbitration in Bengaluru, Karnataka, in accordance with the Arbitration and Conciliation Act, 1996.
  • The courts in Bengaluru shall have exclusive jurisdiction.

10. Final Acknowledgment

BY PURCHASING THIS REPORT, THE USER CONFIRMS:

"I understand that Assetary Pvt Ltd is a data aggregator, not an advisor. I understand that this Report is based on public records which may be incomplete. I accept full responsibility for my property buying decision and release Assetary Pvt Ltd from all liability regarding the outcome of my investment."
